Terms of Use

Effective date: September 15, 2026  ·  Last updated: September 15, 2026

These Terms of Use (the Terms) govern access to and use of the CLEAR public platform at clear.pulmhealthfoundation.org and the PulmHealth Foundation website at pulmhealthfoundation.org (collectively, the Services). The Services are operated by PulmHealth Foundation, a Colorado nonprofit corporation (Foundation, we, us, or our).

By accessing or using the Services, you agree to these Terms. Our Privacy Policy describes how we handle personal information. If you do not agree to these Terms, do not use the Services.

1. Who provides CLEAR

CLEAR is developed and owned by PulmHealth LLC and made available to the Foundation under license for public, noncommercial use. The Foundation operates the public platform in furtherance of its charitable mission. Commercial and enterprise capabilities are offered separately by PulmHealth LLC.

The Foundation and PulmHealth LLC are separate legal entities. The Foundation does not own the CLEAR technology, and PulmHealth LLC does not own the Foundation or control its charitable assets.

2. Eligibility and accounts

You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of majority where you live, a parent or legal guardian must authorize your use and agree to these Terms for you. The Services are not directed to children under 13.

Some features may be available without an account. We may require a free account for continued or expanded use. You agree to provide accurate information, keep your credentials confidential, promptly notify us of suspected unauthorized use, and accept responsibility for activity under your account. You may not share, sell, transfer, or provide another person access to your account.

3. Permitted use

Subject to these Terms, the Foundation grants you a limited, revocable, non-exclusive, non-transferable right to access and use the public Services for lawful personal, educational, research, and public-interest purposes. This permission does not transfer ownership or grant rights to non-public software, models, systems, or datasets.

4. Informational use only

CLEAR provides environmental and public-health information for education, research, context, and decision support. It does not provide medical advice, diagnosis, treatment, emergency guidance, a regulatory determination, a legal opinion, or professional engineering or environmental consulting advice. Consult qualified professionals and authoritative agencies for decisions requiring professional judgment. If you have a medical emergency, call 911 or your local emergency service.

5. Measurements, location, and causation

Measurements may come from monitoring locations away from a place you select and may reflect different instruments, methods, time periods, units, quality controls, detection limits, and reporting requirements. Data may be delayed, corrected, incomplete, unavailable, or unsuitable for a particular purpose.

Proximity, wind alignment, modeled context, compound overlap, a statistical association, or a displayed facility record does not by itself establish personal exposure, source contribution, causation, a legal violation, regulatory status, or whether a facility was operating at a particular time. Modeled, inferred, summarized, and AI-assisted information is not a direct measurement unless expressly identified as one. You are responsible for evaluating the information and its limitations before using it.

6. AI-assisted information

CLEAR may use artificial intelligence and automated methods to organize, summarize, and explain source-linked evidence. AI-assisted output can be incomplete, outdated, or incorrect and may omit relevant context. It does not replace the underlying records or professional review. Review cited sources, dates, methods, and stated limitations before relying on an assessment. Do not use CLEAR output as the sole basis for a medical, legal, regulatory, employment, insurance, housing, credit, educational, emergency, or other high-impact decision.

7. Sources, methodology, and no endorsement

CLEAR integrates information from governmental, scientific, public, licensed, and other identified sources. Coverage, recency, accuracy, and permitted uses vary by source. The Data Sources and Methodology Notice describes important sources and limitations. Source names and marks identify provenance only. No agency, institution, standards body, map provider, or data provider endorses CLEAR, PulmHealth LLC, or the Foundation unless an express written endorsement is identified.

8. Acceptable use

You may not, and may not help another person to:

  • use the Services unlawfully, fraudulently, or to infringe another person's rights;
  • sell, rent, lease, sublicense, commercially redistribute, or provide paid access to the Services or any substantial portion of them;
  • copy, modify, translate, or create derivative works of non-public technology or protected content except as applicable law or an identified third-party license expressly permits;
  • reverse engineer, decompile, disassemble, discover source code, extract models or model weights, probe non-public components, or bypass technical limitations, except to the extent applicable law prohibits this restriction;
  • scrape, crawl, harvest, bulk download, or access the Services through automated means without our prior written permission, including for model training, dataset creation, or commercial benchmarking;
  • evade account requirements, rate limits, robots instructions, access controls, or security protections;
  • introduce malware, test vulnerabilities without authorization, interfere with availability, overload infrastructure, or attempt unauthorized access to any account, system, or data;
  • remove or alter source attribution, provenance, timestamps, intellectual-property notices, or disclaimers;
  • submit protected health information, government identification numbers, financial account credentials, or other sensitive personal records;
  • identify, re-identify, track, harass, discriminate against, or cause harm to a person using the Services or information derived from them;
  • represent CLEAR output as a verified direct measurement or conclusive proof when it is not, or imply an endorsement that does not exist; or
  • use the Services to make a final medical, clinical, emergency, enforcement, regulatory-compliance, permitting, employment, insurance, housing, credit, educational, or other high-impact automated decision.

Ordinary use of publicly provided source links and features is permitted. Separate licenses or source-specific terms may govern reuse of underlying data.

9. User submissions and feedback

If you submit an inquiry, correction, comment, or other material, you retain any rights you hold in it. You grant the Foundation a non-exclusive, worldwide, royalty-free license to host, copy, use, reproduce, and adapt the submission only as reasonably necessary to respond, operate and improve the Services, investigate an issue, maintain records, and carry out the Foundation's mission. You represent that you have the right to submit it and that it does not violate law or another person's rights.

If you voluntarily provide an idea or suggestion about the Services, we may use it without restriction or compensation, provided we do not publicly identify you as its source without permission. Do not submit confidential information through a general feedback or contact channel.

10. Corrections

We welcome substantiated reports of inaccurate displays, broken provenance, or other concerns. A correction request does not guarantee that content will be changed or removed. Public records may need to be corrected by the agency or provider that issued them. Contact us using Section 22 and identify the page, record, source, and reason for the request.

11. Availability and changes

The Services may change over time. We may add, modify, suspend, restrict, or discontinue features; correct data; impose reasonable usage limits; and perform maintenance without liability. We do not promise uninterrupted access, support, preservation of a particular feature, or any service level. We are not responsible for outages or changes caused by third-party sources or services.

12. Intellectual property

PulmHealth LLC retains all rights in the CLEAR technology and its CLEAR marks, subject to rights expressly granted to the Foundation. The Foundation retains all rights in its name, marks, educational and research content, and other Foundation content. Public-source data remains subject to the rights, restrictions, and notices of its source. Neither entity claims ownership of public-source data merely because it is displayed or analyzed in CLEAR.

Except for the limited permission in Section 3 and any rights expressly stated with particular content or data, no right or license is granted by implication, estoppel, or otherwise. If you believe material in the Services infringes your copyright or another intellectual-property right, send a detailed notice to the contact in Section 22.

13. Third-party materials and services

The Services may incorporate or link to third-party data, maps, software, models, websites, and services. Third-party materials may have separate terms, attribution requirements, and privacy practices. We do not control and are not responsible for their availability, content, security, accuracy, or practices. A link or integration does not imply endorsement.

14. Privacy

Our Privacy Policy explains how the Foundation handles personal information in operating the Services. Do not submit protected health information or other sensitive records through the Services.

15. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION, OUTPUT, DATA, AND THIRD-PARTY MATERIALS AVAILABLE THROUGH THEM ARE PROVIDED AS IS AND AS AVAILABLE. THE FOUNDATION AND PULMHEALTH LLC DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENCY, SECURITY, AVAILABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY INFORMATION OR RESULT WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR PURPOSE. Some jurisdictions do not permit certain exclusions, so some exclusions may not apply to you.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDATION, PULMHEALTH LLC, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, USE, GOODWILL, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED US$100. These exclusions and limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that applicable law does not permit to be limited.

17. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless the Foundation, PulmHealth LLC, and their respective directors, officers, employees, volunteers, contractors, and agents from third-party claims, damages, judgments, liabilities, costs, and reasonable attorneys' fees arising from your unlawful use or material misuse of the Services, your submission, or your material violation of these Terms or another person's rights. We may control the defense of a claim covered by this section, and you agree to reasonably cooperate. You may not settle such a claim in a manner that admits fault by or imposes an obligation on an indemnified party without that party's written consent.

18. Suspension and termination

We may suspend, limit, or terminate access when we reasonably believe it is necessary to enforce these Terms, protect users or the public, preserve security or availability, comply with law, or address third-party rights. You may stop using the Services at any time. Sections that by their nature should survive will survive, including Sections 5 through 7 and 9 through 22.

19. Governing law and venue

Colorado law governs these Terms, without regard to conflict-of-laws principles. Subject to any law that gives you a right to bring a claim elsewhere, any dispute arising from or relating to these Terms or the Services must be brought exclusively in the state courts located in the City and County of Denver, Colorado, or the United States District Court for the District of Colorado. You and the Foundation consent to personal jurisdiction and venue in those courts.

20. Changes to these Terms

We may update these Terms to reflect changes in the Services, law, or our practices. We will post the revised Terms and update the date above. If a change materially affects registered users' rights or obligations, we will provide additional notice where reasonably practicable. Changes apply prospectively from their stated effective date. Your continued use after that date constitutes acceptance of the revised Terms.

21. General terms

These Terms and any notices or source-specific terms expressly incorporated into them are the entire agreement between you and the Foundation regarding the public Services. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a lawful transfer of the relevant program or assets, provided the assignee assumes the applicable obligations. Headings are for convenience only. Nothing in these Terms creates an employment, agency, partnership, joint venture, fiduciary, or beneficiary relationship.
